Welcome to Dock Designer App (“Service”, “we”, “us”, “our”). By creating an account, purchasing a subscription you (“User”, “Client”, “you”) agree to be bound by these Terms and Conditions (“Terms”). Please read these Terms carefully before using the Service. If you do not agree with any part of these Terms, please refrain from using the Service.

1. Subscription Model

   1. Subscription Plans: We offer a single monthly subscription plan with a 7-day free trial. After the trial, your subscription will automatically renew monthly unless canceled.

   2. Additional Users: You may purchase additional users as an add-on to your subscription. This allows more team members to access the Service under your account.

   3. Automatic Renewal: Subscription Plans renew automatically at the end of each term unless you cancel prior to the renewal date. Upon renewal, we will charge you based on the current subscription rate, unless a different rate is provided by agreement or promotion.

   4. Cancellation and Refunds:

      1. You may cancel your Subscription at any time. Cancellations will take effect at the end of the current subscription term, and no refunds will be issued for the remaining term.

2. User Account

   1. Account Registration: To use our Service, you must create an account by providing accurate information. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

   2. Age Requirement: Users must be at least 13 years old or the age of majority in their jurisdiction to use this Service.

   3. Account Security: You are solely responsible for safeguarding your password and agree not to disclose your password to any third party. You agree to notify us immediately of any unauthorized use of your account.

3. Usage Rights and License

   1. License: Upon purchasing a Subscription Plan, we grant you a limited, non-exclusive, non-transferable, and revocable license to use the Service for the sole purpose of designing docks in accordance with these Terms.

   2. Restrictions: You agree not to:

      1. Resell, sublicense, or otherwise commercialize the Service.
      2. Reverse-engineer, decompile, or otherwise attempt to access the source code.
      3. Use the Service in a way that violates applicable laws or regulations.

4. Payments and Fees

   1. Pricing and Payment: All prices for Subscription Plans and add-ons are listed on our website and are subject to change. You agree to pay the fees associated with the Subscription Plan and any add-ons, and authorize us to charge the applicable payment amount.

   2. Taxes: You are responsible for all applicable taxes, and we reserve the right to add them to your billing amount if required by law.

5. Modifications to Service and Pricing

   1. Changes to Service: We may modify, suspend, or discontinue certain features or functionalities of the Service, including Subscription Plan features, at our discretion, with or without notice.

   2. Pricing Changes: We reserve the right to adjust pricing for our Subscription Plan and any add-ons. Changes in price will be effective at the start of the next billing cycle.

6. Intellectual Property

   1. Ownership: We retain all rights, title, and interest in and to the Service, including all underlying software, technology, designs, and related intellectual property.

   2. User Content: By using the Service, you may upload or input designs and data (“User Content”). You retain ownership of your User Content but grant us a limited, non-exclusive license to use it solely to provide the Service to you.

7. Termination and Suspension

   1. Termination by User: You may terminate your Subscription Plan at any time; however, no refunds will be provided for the remaining term.

   2. Termination by Us: We may suspend or terminate your account and access to the Service if you violate these Terms or engage in unauthorized use. In such cases, no refunds will be issued.

8. Disclaimer of Warranties

   1. As-Is Basis: The Service is provided “as is” without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted or error-free.

9. Limitation of Liability

   1. Limitation: To the fullest extent permitted by law, in no event will we be liable for any indirect, incidental, punitive, or consequential damages, or for any loss of profits or data arising out of or related to your use of the Service.
